Sujit Choudhry Helps Find Solutions to Constitutional Challenges in Ukraine
A group of top scholars including Sujit Choudhry recently met at a workshop in Kiev, Ukraine to discuss constitutional challenges facing Ukraine. The country has suffered for more than two decades. This was caused by the fall of communism in the country.
The workshop was organized by the Center for Policy and Legal reform and the International Institute for Democracy and Electoral Assistance (IDEA). The scholars mainly discussed Ukraine’s semi-presidentialism governance system and constitutional instability.
With the attendance of some Constitutional law luminaries like Sujit Choudhry, Victor Musiaka who is the 1996 Supreme Council president’s representative, Sumit Bisarya of International IDEA and Dalarna University’s Thomas Sidelius, there was no doubt they found new techniques of improving Ukraine’s governmental processes. Several underlying problems were behind these esteemed personalities attendance. Ukraine government has been unstable for 20 years. This is after the communist regime failed. Also, the country keeps getting involved in crises every other time.
These crises include lack of democracy in Ukraine as the presidency holds all the powers. Since other government executives like prime minister lack as much power as the president, subjecting the government to checks and balances is impossible. As a result, problems including corruption are rampant. Additionally, the electoral system in the country is poorly designed; hence political parties lack power. Finding a Solution
Sujit Choudhry and other scholars identified solutions to this instability. These include sharing of power in the executive branch, limiting presidential power and strengthening the legislature. It is expected that the legislature will finally be helpful and able to put the government on its toes.
